Liability

The Program offers information and guidance, but you are fully responsible for your home and any renovations you make. This means:

You are responsible for your application to any rebate or income-qualified program you hope to use, and for meeting all requirements of those programs.

The Program is not responsible for the Energy Advisors or contractors you use, their work and the products they install, or for any other person or organization linked to the program or your renovation. The Program does not endorse any specific product, retailer, Energy Advisor or contractor, and are not liable for the Participant’s selection of materials or products, or the workmanship, operation, performance or warranty associated with any Benefits or associated work performed, whether by a contractor, Energy Advisor, or otherwise, in relation to the Program.

Any estimates of energy savings are not guarantees and depend on your home and the upgrades you make. The Program does not guarantee, and accepts no liability for, the level of energy savings achieved. The Program is not a substitute for an EnerGuide home evaluation. You take on the risk that cost, energy use and other changes resulting from an upgrade might be different than expected.

The Program is not responsible for any losses related to any upgrades you make. Participants hereby agree to indemnify and save harmless the Program, its Collaborating Parties, and their respective directors, officers, agents and employees from all liability, damages, claims, demands, expenses, and costs for claims, costs for injury or death of any person, damage to or destruction of property and all economic loss suffered by any person arising from or occurring by reason of the Program, receipt of a Benefit(s) or actual or alleged preparation, installation or use of the Benefit(s), including any actions or omissions by third-party consultants or contractors in the preparation or delivery of the Benefits(s).

You should confirm any information from the Program with the relevant professional or organization. The Program does not make any representation or warranty about the accuracy, reliability, currency or completeness of any information or material contained on the Program website or on any linked site or provided by Program staff. Links to other websites or organizations do not constitute endorsement of material at those sites, or any associated organization, product or service.

You are responsible for safe installation, modification, removal, or disposal/recycling of products and equipment according to all applicable laws and rules.
